Welcome to Healthy Pet Accessories

These Terms of Use (“Terms”) govern your access to and use of our website, customer portal, and services. By accessing or using our platform, you agree to comply with these Terms. Please read them carefully.

  1. Introduction
    1. These Terms apply to all users of the Healthy Pet Accessories website and customer
      portal.
    2. By registering for the portal or using the website, you agree to accept these Terms in
      their entirety, including any future amendments.
    3. Access to the customer portal is restricted to verified businesses, such as vet shops, pet shops, and other approved entities, which have completed our registration process.
    4. Updates to these Terms will be communicated via email or on our website. Continued use of our platform constitutes acceptance of any changes.
  2. Customer Portal Usage
    1. The customer portal provides registered users with the ability to:
      • Place orders for products.
      • View and download invoices and credit notes.
      • Browse the full product catalogue, including pricing, descriptions, and images.
    2. All users must register and undergo verification by our web team before accessing the portal.
    3. Misuse of the portal, such as sharing login credentials, pricing information, or proprietary details, is strictly prohibited and may result in account suspension, termination, or legal action.
    4. Healthy Pet Accessories reserves the right to collect and analyse portal usage data, including purchasing behaviour, to improve services.
    5. The portal must only be used for lawful purposes in compliance with these Terms.
  3. Pricing, Confidentiality, and Non-Disclosure
    1. Pricing information is accessible only to registered and approved users. All prices and quotes provided are exclusive of VAT and must not be shared publicly or disclosed to third parties, including competitors.
    2. By agreeing to these Terms and Conditions, all users (including businesses, their employees, and representatives) acknowledge that they are bound by a Non-Disclosure Agreement (NDA). This NDA prohibits the direct or indirect sharing of any confidential information, including but not limited to:
      • Pricing, discounts, and promotional o ers.
      • Product catalogues, specifications, or proprietary business strategies.
      • Any communications or agreements with Healthy Pet Accessories.
    3. Breach of Confidentiality: Any unauthorized sharing or disclosure of confidential information may result in:
      • Immediate suspension or termination of access to the portal.
      • Legal action to recover damages or enforce compliance.
    4. Errors and Omissions Excepted (E&OE): Prices are subject to change without prior notice. Discrepancies due to typographical errors will not be honoured.
  4. Placing and Managing Orders
    1. Orders can be placed directly through the customer portal. Users are responsible for ensuring the accuracy of their orders before submission.
    2. Order cancellations or modifications may be accommodated at the sole discretion of Healthy Pet Accessories. Cancellations made after an order has been processed may incur an administrative fee of 2.5% of the order value, exclusive of VAT.
    3. Healthy Pet Accessories reserves the right to reject or cancel orders at its discretion.
    4. Any discrepancies in orders or invoices must be reported within 3 business days of receipt.
    5. Customers are required to adhere to agreed delivery schedules and accept deliveries at the provided address. Repeated refusal or failure to accept deliveries may result in account suspension.
  5. Payment Terms
    1. We accept payments via EFT, credit card, and other terms assigned during account setup.
    2. Payment terms may include 30-day accounts, cash-on-delivery (COD), or prepayment options based on customer history.
    3. Any costs incurred from failed payments, including bank charges, will be charged to the customer.
    4. Late payments will incur interest at a rate of 2% per month, or the maximum allowed by law, whichever is lower.
    5. All invoices and payments are subject to VAT at the applicable rate.
  6. Order Fulfilment and Delivery
    1. Deliveries to central city areas (including Cape Town CBD and other major city centres):
      • Orders valued at R2,500 or more qualify for free delivery (exclusive of VAT).
      • Orders below R2,500 are subject to a standard delivery fee of R250 (exclusive of VAT).
    2. Deliveries to areas outside city centres:
      • Delivery fees are calculated based on the distance, courier availability, and order value.
      • Customers in remote or outlying areas may incur higher delivery fees, which will be communicated during the checkout process or via confirmation from our logistics team.
    3. Delivery times range from 2 to 7 working days, subject to stock availability and the customer’s geographic location. Customers will be notified of any delays.
    4. Healthy Pet Accessories reserves the right to adjust delivery fees for specific locations based on transport costs.
    5. If goods are damaged during delivery, customers must notify us within 24 hours of receipt with photographic evidence to qualify for a replacement.
    6. All quotes, including delivery fees, are exclusive of VAT unless otherwise stated.
  7. Returns and Refunds
    1. Returns for perishable items, such as dog treats, are accepted only if the product is defective (e.g., mouldy or infested) and within its best-before date.
    2. Returns for non-perishable items, such as pet carriers or toys, are accepted only if damaged upon delivery or at management’s discretion.
    3. Customers must initiate a return request within 7 days of delivery, providing proof of purchase and photographic evidence where applicable.
    4. Refunds will be processed within 14 business days of approval and issued as store credit.
  8. Privacy Policy
    1. Healthy Pet Accessories is committed to protecting your privacy and complies with South Africa’s POPIA (Protection of Personal Information Act).
    2. Customer data is used to enhance our services, including tailored marketing and product recommendations.
    3. Cookies are used to save login details and track device usage. Customers can opt out of non-essential cookies via browser settings.
    4. Customer data will not be shared with third parties without prior consent, except where required by law.
  9. Account Security
    1. We employ encryption and other security measures to protect user data.
    2. Customers are responsible for maintaining strong passwords and keeping them confidential.
    3. Healthy Pet Accessories is not liable for unauthorized access resulting from weak or compromised passwords.
    4. Users must notify us immediately in the event of unauthorized access or a
      suspected security breach.
  10. Intellectual Property and Prohibited Activities
    1. All content on our website, including images, text, trademarks, and other
      materials, is the intellectual property of Healthy Pet Accessories.
    2. Users are prohibited from copying, reproducing, or redistributing any content without prior written consent.
    3. The use of automated tools, such as web scraping, to extract data from the platform is strictly prohibited.
    4. Any infringement of intellectual property rights may result in legal action.
  11. Limitations of Liability
    1. Healthy Pet Accessories strives for accuracy in product descriptions and pricing but is not liable for typographical errors or omissions.
    2. Liability for direct, indirect, or consequential damages is limited to the maximum extent permitted by law.
    3. Customers agree to indemnify Healthy Pet Accessories against any claims arising from their misuse of the platform.
  12. Governing Law and Dispute Resolution
    1. These Terms are governed by the laws of South Africa.
    2. In the event of a dispute, parties must attempt resolution through mediation before pursuing legal action.
    3. Disputes unresolved through mediation will be subject to the jurisdiction of South African courts.
  13. Promotions and Discounts
    1. Promotional offers are valid only during the specified time frame and are subject to availability.
    2. Discounts cannot be applied outside the promotional period. Healthy Pet
      Accessories reserves the right to modify or withdraw promotions at any time without prior notice.
  14. Customer Reviews
    1. Customer reviews reflect the opinions of the reviewer and do not represent the views of Healthy Pet Accessories.
    2. We reserve the right to moderate or remove customer reviews deemed inappropriate, misleading, or offensive.
  15. Force Majeure
    1. Healthy Pet Accessories is not liable for delays or failures caused by events beyond our control, including but not limited to natural disasters, strikes, government actions, or transportation disruptions.
  16. General Provisions
    1. Entire Agreement: These Terms constitute the entire agreement between the parties regarding the subject matter.
    2. Severability: If any provision of these Terms is found invalid, the remaining provisions shall remain enforceable.
    3. Waiver: Failure to enforce any provision of these Terms does not constitute a waiver of the right to enforce it later.
